Statement from Jay Russell | Developer of J. Russell Communities

 

At J. Russell Communities, we value professionalism, integrity, and respect for the real
estate industry’s established standards. We expect all real estate licensees working in
and around our new home communities to abide by the rules and regulations set forth
by the Kansas Real Estate Commission, the South Central Kansas Association of
REALTORS®, and the National Association of REALTORS®.
To be clear, these rules are not optional, they are enforceable standards that guide how
we operate and how others may represent our homes, builders, and neighborhoods.

The following policies are strictly enforced across all J. Russell Communities:

  

  

Advertising & Marketing

 

Outside advertising of our new home listings or subdivisions is not permitted. Use of
our photographs, marketing materials, or online content for self-promotion or buyer
solicitation without written permission is a violation of both MLS Rules and REALTOR®
Code of Ethics.

    

Communication with Sellers (Builders)

 

Cooperating agents are not to contact our builders (sellers) directly. All inquiries,
negotiations, and buyer representation should be handled through our dedicated on-site
listing agents. Direct contact violates KREC regulations regarding exclusive agency
agreements.

    Representation & Solicitation

 

REALTORS® shall not solicit listings that are under exclusive agreement with another
broker, nor shall they advertise or present property without proper authority. This
applies to print, online platforms, and all forms of digital media.

 

Supporting Standards & Regulations:

 

    •    MLS Rules & Regulations 5.1: No listing shall be advertised by anyone other than
the listing broker without prior written consent.
    •    KREC Rules & Regulations 58-30,108 (p): Licensees may not contact or negotiate
directly with a seller who has an exclusive agreement with another broker.
    •    NAR Code of Ethics Standards 12-4, 12-10, and 16-4: REALTORS® must present
a true picture in advertising, must not use content without permission or attribution, and
must not solicit listings already under exclusive representation.

Our communities thrive when cooperation is handled with professionalism and respect
for these rules. We appreciate the agents who uphold these standards and work with
